MOVE Against Cancer – consultation on proposed change to the objects of the charity

The Trustees of MOVE charity are seeking the views of anyone with an interest in the charity on their proposals to make minor amendments to the objects of the charity to clarify the intent and effect of the charity’s objects (and hence the services and support it provides).

The objects of the charity adopted in 2016 when the charity was formed read as follows:

To protect and promote good health among children and young people recovering from cancer by the provision of individual physical activity programmes, one to one support and guidance designed to assist their recovery and help them engage with physical activity in a way that will benefit their health throughout their lives.

Nothing in this constitution shall authorise an application of the property of the CIO for the purposes which are not charitable in accordance with section 7 of the Charities and Trustee Investment (Scotland) Act 2005 and section 2 of the Charities Act (Northern Ireland) 2008.

The current objects of the charity were adopted in 2024 (following consent from the Charity Commission) and are as follows:

To protect and promote good health among people recovering from cancer by the provision of individual physical activity programmes, one to one support and guidance designated to assist their recovery and help them engage with physical activity in a way that will benefit their health throughout their lives.

The Trustees are proposing amended objects for the charity as follows:

To protect and promote good health among people recovering from, or living with, cancer by the provision of physical activity programmes, support and guidance designed to assist their recovery and help them engage with physical activity in a way that will benefit their health throughout their lives.

The proposed amended objects, seek to remove ambiguity in the charity’s objects including to:

Clarify that the charity can support people with cancer whose prognosis is such that they are not expected to recover from cancer (i.e. they are not expected be cancer free in the future) and not only those who are expected to recover to remission. This was always the intention of the objects when originally drafted but the trustees are concerned that an overly strict interpretation of “recovering from cancer” could prevent the charity from supporting people living with cancer (but who are not expected to recover to remission) even though people “living with” cancer can and do benefit from the physical activity programmes, support and guidance provided by the charity.
Remove the words “individual” and “one-to-one” to clarify that collective participation in physical activity programmes with others is permitted by the objects (as always intended) and to clarify that group support and guidance can be offered, not only one-to-one, (which was always the intention and has always been the practice of the charity –one-to-one support is provided within group settings as well as individually).
Correct a typographical error in the original objects (“designated” should be “designed”).

As such, the services of the charity will remain unchanged and the proposed amendments to the objects are only intended to clarify that people with cancer who are not expected to recover to remission can benefit and that collective physical activity and group support and guidance are acceptable ways to deliver these programmes.

Before the Trustees apply to the Charity Commission for England and Wales for authorisation to amend the objects, they are inviting views on the proposed amendments from anyone with an interest in the charity.
